1.1. Engagement Mobile Strategies Product

Welcome to Mobile Engage Pro, a product of Engagement Mobile Strategies! This Product is a platform designed to connect people through unforgettable live experiences. 

At Engagement Mobile Strategies (the "Company," "we," "our," or "us"), your privacy is our top priority. This Privacy Policy outlines how we collect, use, disclose, and protect your information when you use Mobile Engage Pro (the "Product"). By accessing or using the Product, you agree to the terms of this Privacy Policy.

1.2. Who’s Who

In this Privacy Policy, the term "Organizer" refers to event creators using the Product to:
A. Provide information about events or enable attendance by Consumers ("Consumers").
B. Engage in other activities related to the Product.

Organizers, Consumers, and third parties using the Product are collectively referred to in this Privacy Policy as "Users," "you," or "your".

You are contracting with Engagement Mobile Strategies, the legal entity responsible for providing and operating Mobile Engage Pro. Engagement Mobile Strategies is a Virginia company with its principal place of business at 42871 Littlehales Terrace, Ashburn, VA 20148.

2. Our Privacy Statement

This Privacy Policy outlines our approach to information that can be associated with or used to identify an individual ("Personal Data") collected from Users through the Product. We take your Personal Data seriously, which is why we have created this Privacy Policy. Please read it carefully as it contains important details about how your Personal Data is handled.

3. Personal Data That We Collect

When you use or interact with the Product or engage with the Company, we may collect Personal Data. Sometimes this data is collected on behalf of the Company, and other times on behalf of an Organizer using the Product to run an event. This distinction is important under certain data protection laws and is explained in detail below.

3.1. Information Collected From All Users

We collect Personal Data from all Users when such data is voluntarily provided through the Product. For example, this includes when you register for access to the Product, contact us with inquiries, respond to surveys, register for an event, or browse and use specific features of the Product. The types of data we collect may include your name, address, email address, content you have expressed interest in (such as through viewing, clicking, liking, following, or searching on the Product), and any other information you provide that allows you to be personally identified.

We also collect certain data automatically from the computer, mobile device, or browser you use to access the Product. This data, referred to as "Automatic Data," may include a unique identifier associated with your device or browser, such as your Internet Protocol (IP) address, as well as characteristics about your device or browser. It also includes statistics about your activities on the Product, information about how you navigated to the Product, and data collected through Cookies, Pixel Tags, Local Shared Objects, Web Storage, and other similar technologies. This automatically collected data, including your IP address, may be disclosed to or collected directly by our vendors, who use it to help us analyze how the Product is used.

3.2. Information Collected From Organizers

If you are an Organizer, we may collect additional Personal Data as part of your use of the Product. In some cases, we collect financial information, such as your credit card number, expiration date, billing address, or bank account details, to facilitate payments or for tax purposes. When creating an event, we may also ask for your phone number and send a verification text to prevent fraudulent activity on the Product.

We may also collect additional information about you from third-party sources, including your name, email address, and other contact details obtained from marketing partners, third-party websites, your bank, payment processing partners, or credit reporting agencies.

3.3. Information Collected From Consumers

If you are a Consumer, we may collect additional Personal Data about you, either for our own purposes or on behalf of an Organizer. For example, when you register for a paid event, you may provide financial details such as your credit card number, expiration date, and billing address, some of which may constitute Personal Data. Organizers may also use the Product to set up event registration pages and collect a variety of data. It is important to note that the Company does not control how Organizers configure their registration pages or the specific data they choose to collect.

When you register for or interact with an event or activity organized through the Product, any data you provide will be shared with the relevant Organizer. The Organizer may use this data in accordance with their own privacy policies.

We may also receive additional Personal Data about you from third-party sources, including Organizers, other Consumers, social media platforms, your credit card issuing bank, payment processing partners, or other third parties.

4. How We Use Your Personal Data

We collect and use the Personal Data we gather in a manner that is consistent with this Privacy Policy, applicable privacy laws, and the practices of Engagement Mobile Strategies (the "Company"). We may use your Personal Data as described below:

4.1 Specific Reason

If you provide Personal Data for a specific purpose, the Company will use that data in connection with the purpose for which it was provided. For example, if you contact us via email, we will use the Personal Data you provide to respond to your inquiry or resolve your issue, and we will reply to the email address from which the contact was made.

4.2 Access and Use

If you provide Personal Data to access or use the Product or any of its features, the Company will use that Personal Data to grant you access to the Product or its functionality and to analyze your usage of such features. 

4.3 Internal Business Purposes

We may use your Personal Data for internal business purposes, including but not limited to improving the content and functionality of the Product, better understanding our Users, enhancing the Product, identifying or addressing wrongdoing, enforcing our Terms of Use, managing your account, providing customer service, and generally overseeing the Product and our business operations.

4.4 Organizer Emails

We allow Organizers to use our email tools to contact Consumers for current and past events. As a result, you may receive emails from our system originating from such Organizers, which we send on their behalf. If you have registered for an event on the Product, your email address will be accessible to the relevant Organizer. However, Organizers may also import email addresses they have from other sources and send communications through the Product to those email addresses, with us delivering the emails on their behalf. It is the Organizer, not Engagement Mobile Strategies (the "Company"), who is responsible for sending these emails. 

4.5 Other Purposes

If the Company intends to use any Personal Data in a manner that is not consistent with this Privacy Policy, you will be notified of the anticipated use prior to or at the time the Personal Data is collected, or we will seek your consent after the collection but before the use.

5. How We Disclose And Transfer Your Personal Data.

5.1 Background.

The Company is not in the business of selling your Personal Data. We consider this information a vital part of our relationship with you, which is why we do not sell your Personal Data to third parties. 

There are certain circumstances in which the Company may disclose, transfer, or share your Personal Data with third parties without further notice to you, as set forth in this Privacy Policy.

5.2 Business Transfers.

As we develop our business, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, dissolution or similar event, Personal Data may be part of the transferred assets. We may also disclose your Personal Data in the course of due diligence for such an event. You acknowledge and agree that any successor to or acquirer of Engagement Mobile Strategies (or its assets) will continue to have the right to use your Personal Data and other information in accordance with the terms of this Privacy Policy.

5.3 Organizers

When you provide your Personal Data (such as through a web form) to communicate with an Organizer or participate in an Organizer activity, that Organizer will receive your information. For example, if you enter your name and email address into a web form for an Organizer activity, the Organizer will receive that information. The Organizer may then send you communications, which may be subject to their own, separate privacy policy.

In some cases, an Organizer may appoint a third party, which may or may not be affiliated with the Organizer, to create a page on their behalf (these third parties are referred to as "Third Party Organizers"). In such cases, the Company may provide your Personal Data to the Third Party Organizers on behalf of the Organizers. We are not responsible for the actions of these Organizers, Third Party Organizers, or other downstream recipients of your Personal Data with respect to how they use your Personal Data. It is important that you review the applicable privacy policies of the Organizers and, if applicable, their appointed Third Party Organizers before providing Personal Data or other information in connection with an event or related activity.

5.4 Legal Requirements

We may disclose your Personal Data if required by law to do so, for example, to respond to a subpoena or request from law enforcement, a court, or a government agency (including in response to public authorities for national security or law enforcement purposes). The Company may also disclose your Personal Data in good faith if it believes such action is necessary to (a) Comply with a legal obligation, (b) Protect or defend our rights, interests, or property, or that of third parties, (c) Prevent or investigate potential wrongdoing in connection with the Product, (d) Act in urgent circumstances to protect the personal safety of Users of the Product or the public, or (e) Protect against legal liability.

6. How We Store Your Personal Data.

We may store Personal Data itself or such information may be stored by third parties to whom we have transferred it in accordance with this Privacy Policy. We take what we believe to be reasonable steps to protect the Personal Data collected via the Product from loss, misuse, unauthorized use, access, inadvertent disclosure, alteration and destruction. However, no network, server, database or Internet or email transmission is ever fully secure or error free. Therefore, you should take special care in deciding what information you send to us electronically. Please keep this in mind when disclosing any Personal Data.

7. How You Can Access, Update, Correct or Delete Your Personal Data.

You can access or delete your Personal Data stored by us.

You can edit some of your Personal Data directly through your account. In certain cases, you can ask us to correct and update any inaccurate Personal Data using our contact information, and we will consider your request in accordance with applicable laws.

If a Consumer initiates a data deletion request, Engagement Mobile Strategies is authorized to delete or anonymize Personal Data of the requesting Consumer from the Product even if that means removing its availability to the Organizer through the Product. However, if you are a Consumer, you understand that even if Engagement Mobile Strategies deletes or anonymizes your Personal Data upon your request or pursuant to this Policy, your Personal Data may still be available in the Organizer's own databases if transmitted to the Organizer prior to Engagement Mobile Strategies receiving or taking action on any deletion or anonymization activity.

8. How Long We Retain Your Personal Data.

We may retain your Personal Data as long as you are registered to use the Product. You may delete your account by visiting the Account Settings page. However, we may retain Personal Data for an additional period as is permitted or required under applicable laws. Even if we delete your Personal Data it may persist on backup or archival media for an additional period of time for legal, tax or regulatory reasons or for legitimate and lawful business purposes. For sales customers and prospects, we retain your data as long as we maintain a relationship with you and for a limited period of thereafter as necessary to meet business and legal requirements.

10. Your Choices.

You have several choices available when it comes to your Personal Data:

10.1 Limit the Personal Data You Provide.

You can browse the Product without providing any Personal Data (other than Automatic Data to the extent it is considered Personal Data under applicable laws) or by limiting the Personal Data you provide. If you choose not to provide any Personal Data or limit the Personal Data you provide, you may not be able to use certain functionality of the Product.

10.2 Opt Out from Electronic Communications.

(a) Organizer-initiated Communications 

Organizers may use our email tools to send electronic communications to those on their email subscription lists, including Consumers who have registered for their events on the Product in the past. Although these electronic communications are sent through our system, Engagement Mobile Strategies does not determine the content or the recipients of these electronic communications. Organizers are required to use our email tools only in accordance with all applicable laws. Engagement Mobile Strategies provides an "Unsubscribe" link on each of these emails, which allows recipients to "opt out" of electronic communications from the particular Organizer.

(b) Transactional or Responsive Communications.

Certain electronic communications from Engagement Mobile Strategies are responsive to your requests. For instance, if you email our customer support department, we will return your email. Notwithstanding any unsubscribe election that you have made, you will still receive these transactional or responsive emails. You can stop receiving these types of emails only by contacting us.

(c) Retention.

Even after you opt out of all electronic communications, we will retain your Personal Data in accordance with this Privacy Policy, however, we will no longer use it to contact you. However, Organizers who have received your Personal Data in accordance with this Privacy Policy may still use that Personal Data to contact you in accordance with their own privacy policies, but they may not use our system to do so.

11. Exclusions.

11.1 Personal Data Provided to Others.

This Privacy Policy does not apply to any Personal Data that you provide to another User or visitor through the Product or through any other means, including to Organizers on event pages or information posted by you to any public areas of the Product.

11.2 Third Party Links.

This Privacy Policy applies only to the Product. The Product may contain links to other websites not operated or controlled by us (the "Third Party Sites"). The policies and procedures we described here do not apply to the Third Party Sites. The links from the Product do not imply that we endorse or have reviewed the Third Party Sites. We suggest contacting those sites directly for information on their privacy policies.

12. Children - Children's Online Privacy Protection Act.

We do not knowingly collect Personal Data from children under the age of thirteen (13). If you are under the age of thirteen (13), please do not submit any Personal Data through the Product. We encourage parents and legal guardians to monitor their children's Internet usage and to help enforce our Privacy Policy by instructing their children never to provide Personal Data through the Product without their permission. If you have reason to believe that a child under the age of 13 has provided Personal Data to us through the Product, please contact us and we will endeavor to delete that information from our databases.

13. International Privacy Laws.

If you are visiting the Product from outside the United States, please be aware that you are sending information (including Personal Data) to the United States where our servers are located. That information may then be transferred within the United States or back out of the United States to other countries outside of your country of residence, depending on the type of information and how it is stored by us. These countries (including the United States) may not necessarily have data protection laws as comprehensive or protective as those in your country of residence; however, our collection, storage and use of your Personal Data will at all times continue to be governed by this Privacy Policy.

14. Changes To This Privacy Policy.

The Product and our business may change from time to time. As a result, at times it may be necessary for us to make changes to this Privacy Policy. We reserve the right, in our sole discretion, to update or modify this Privacy Policy at any time (collectively, "Modifications"). Modifications to this Privacy Policy will be posted to the Site with a change to the "Updated" date at the top of this Privacy Policy. In certain circumstances Engagement Mobile Strategies may, but need not, provide you with additional notice of such Modifications, such as via email or with in-Service notifications. 

Please review this policy periodically, and especially before you provide any Personal Data. This Privacy Policy was updated on the date indicated above. Your continued use of the Product following the effectiveness of any Modifications to this Privacy Policy constitutes acceptance of those Modifications. If any Modification to this Privacy Policy is not acceptable to you, you should cease accessing, browsing and otherwise using the Product.
